Top Uses for the Bill of Sale

The Bill of Sale is a frequently used document any time property is bought and sold. Transferring a vehicle between two people or business requires a Bill of Sale. When you try to register your car you will need to show the town clerk or DMV substation the Bill of Sale to prove you own the vehicle.

If your vehicle has a title, you can use any Bill of Sale form. If your vehicle does not have a title, the DMV has a special Vehicle Sale/Transfer Report for you to use as a Bill of Sale.

Top Components of the Bill of Sale

The Bill of Sale is a contract that protects both the seller and the buyer by outlining the transaction. A completed Bill of Sale will include certain information:

    • Description, including Vehicle Identification Number (VIN), of the property being sold.
    • Date of transfer.
    • Signatures of both buyer and seller.
    • Warranties, both implied and expressed.

Many private sales also use the phrase "As Is, As Seen" to clarify that you don't warranty the vehicle. If a dispute comes along after you have sold the car you will be glad to have a clear understanding of what the warranty expectation is.

Buying a Used Car? Order a Vehicle History Report First

Ordering a vehicle history report is a critical step in the used car buying process. Failing to do so could result in the purchase of a vehicle with frame, flood, or fire damage, odometer rollback and more. Stay on the safe side, and order a vehicle history report before you buy a used vehicle.

    Top Record Keeping

Both the seller and the buyer will get a copy of the signed Bill of Sale. You will want to keep the Bill of Sale with your vehicle title and other warranty records. When you register the vehicle you will show the town clerk the Bill of Sale but it will be returned to you for your own records.
